Terms of Service

These Terms of Service (hereinafter "Terms") govern your access to and use of the SwipEat mobile application and associated website. By downloading the application or using our services, you accept without reservation the entirety of these Terms.

1. Description of Services

SwipEat provides an interactive restaurant recommendation platform. The features include:

• Browsing food spot listings and culinary dishes using interactive swipe decks.
• Creating real-time private group lobbies ("SwipEat in Group") to swipe and match on mutual choices.
• A digitalized loyalty card program allowing you to collect stamps at partner merchant locations via QR Code.
• A table reservation booking module, subject to approval by the restaurant.
• A community gallery to submit dishes photos in exchange for merit-based rewards.

2. User Registration and Account Security

Using certain features requires the creation of a user account. You agree to provide accurate, current, and complete information.

You are solely responsible for maintaining the confidentiality of your credentials (email and password) and all activities under your account. In case of unauthorized or suspicious activity, notify our support team immediately.

Professional restaurateur accounts are subject to manual verification and validation of business credentials by our administrators before activation of commercial tools.

3. Intellectual Property

The SwipEat brand, its logo, design, source code, match algorithms, and all visual or textual assets in the app are the exclusive property of SwipEat.

Any unauthorized reproduction, distribution, or modification of these assets is strictly prohibited and subject to legal prosecution.

When you submit photos of dishes in the app, you grant SwipEat a free, worldwide, non-exclusive license to display, modify, and use these images for operating and promoting the application.

4. Acceptable Conduct and Moderation

You agree to use SwipEat in compliance with all applicable laws and respect other users. The following are strictly prohibited:

• Uploading inappropriate, abusive, vulgar, or copyrighted photos that do not belong to you.
• Harassing or causing harm to other users during group swipe sessions or interacting with merchants.
• Any attempt to cheat or manipulate loyalty stamp points or community reward systems.

SwipEat reserves the right to moderate contributions, suspend, or permanently delete accounts that violate these guidelines without prior notice or compensation.

5. Limitation of Liability and Bookings

SwipEat acts as a mere technical intermediary connecting gourmets with independent restaurants.

Consequently:

• SwipEat does not guarantee table availability or service quality at the restaurants. A booking is only legally binding once officially confirmed by the merchant.
• Partner restaurants are solely responsible for their cooking, price accuracy, and fulfillment of loyalty rewards.
• SwipEat disclaims all liability for any merchant disputes, booking issues, billing errors, or food poisoning occurring at third-party establishments.

6. Changes to These Terms

SwipEat reserves the right to modify these Terms at any time to adapt to new app features or regulations. The effective date at the top of these Terms will be updated accordingly.

7. Governing Law

These Terms are governed by French law. Any dispute relating to their validity or performance will be submitted to the exclusive jurisdiction of the competent courts.
